Emirate creation: Adamawa Court fixed Dec. 4th for Continuation of Defense

Adamawa State High Court IV sitting in Yola on Thursday adjourned a case challenging the Adamawa government for the creation of the Fufore emirate council from Adamawa emirate to December 4th for continuation of defense.
Justice Musa Usman who presided over the case said, this after hearing of both the plaintiff’s and defendant’s counsels examining the sole witness of the defense, Abubakar Jijiwa, Wazirin Fufore.
The case which was filed by the three traditional titles holders of Adamawa emirate; Alhaji Musa Halilu, Dujuma Adamawa, Mustapha Dahiru, Yarima Adamawa and Alhaji Mustapha Ahmadu, Sarki Noma Adamawa that due process was not followed before the creation of Fufore emirate.
While under examination by the prosecution and defense counsels, Jijiwa was asked to confirm to the court if he was part of the stakeholders that requested for the creation of the Fufore Emirate.
Jijiwa confirmed that they wrote a letter of request for the creation of the fufore Emirate to Gov. Ahmadu Umaru Fintiri of the state on the 9th of December 2024.
Mohammed Nuruddeen SAN, defendant counsel told newsmen at the end of the Court session that the 4th defendant had given evidence in the court while the third defendant couldn’t make it to the court because he was bereaved.
Answering a question on the earlier withdrawals of appeals by the two defense counsels at the court of Appeal accusing the trial court of not allowing their application for preliminary objections regarding some issues.
Nuruddeen advanced that the defense counsels filed interlocutory Appeals and the prosecution counsels responded swiftly.
“They said that, the court didn’t consider their Applications for preliminary objection instead of ruling the court adjourned with sunsuit adjournment which in our view was the right thing to do,so we responded in like manner.
“When they saw the Appeals were going no where,they withdrew and the Appeals were dismissed by the court forthwith”, he said.
